This is outlined in the relevant order form provided by the Company and executed by the Client to procure the Ad Services Package pursuant to these Terms and the terms of the Advertising Agreement.

 

  • Client: Represents the entity that is a party to the Advertising Agreement.

 

  • Customer: Encompasses any customer of the Client

 

Effective Date: The date indicated at the top of these Terms.


Intellectual Property Rights: Refers to all intellectual property, including patents, trademarks, rights in goodwill, database rights, data rights, designs, copyrights, topography rights, inventions, know-how, trade secrets, confidential information, customer and supplier lists, and other proprietary knowledge and information. This includes both registered and unregistered rights, as well as applications for registration, renewals, and extensions, regardless of jurisdiction.

Material: Refers to content and materials published on the Website or provided by the Company in connection with the Service.

Posting Agents: Third-party agents, services, or intermediaries that offer to post Material to the Service
on behalf of others.

Privacy Policy: The privacy policy of the Company, as updated from time to time.
Product: Encompasses properties, scholarships, shipping services, vehicles, furniture & home decor, mobile phones, jobs, electronics, fashion & beauty commodities, services, and other items available for purchase on https://emall.rw/.

Registration Details: The information required from Users when registering for the Website, including but not limited to name, phone numbers, email address, age, and/or address.

Service: Refers to the provision of the Website and the Products offered.

consent. Impersonate any person or entity, including Company employees.

c. Infringe upon Intellectual Property Rights or proprietary rights of third parties.
Contain pyramid schemes, spam, unsolicited advertisements, or links to commercial
services, unless specifically allowed by the Company.

4. License for User Material: By submitting User Material, Users grant E_MALL Limited a royalty-free, perpetual, irrevocable, and non-exclusive right and license to use, reproduce, distribute, display, modify, and edit the User Material.

5. Company’s Discretion: The Company may remove or edit User Material at any time and is not obligated to pay any fees for such material

6. Posting Procedure: Users may post User Material on the Website following the Company’s procedures, provided it is not illegal, misleading, obscene, abusive, threatening, defamatory, or objectionable.

7. Limited License: The Company grants Users a limited, revocable, non-exclusive license to access and use the Service for personal use only. This license does not include certain activities such as use by Posting Agents or data mining.

8. Exception for Search Engines: General-purpose internet search engines and non-commercial public archives may engage in certain activities if they comply with the Company’s robots.txt file.

9. Hyperlinking Policy: Users may display individual postings on their website for non-commercial and/or news reporting purposes only, subject to limitations imposed by the Company.

10. Termination of Unauthorized Use: Unauthorized use of the Service terminates any permission or license granted herein. Users must obtain a license from the Company for commercial use or other purposes beyond the scope of authorized access.

FEATURED ADS AND PAID POSTINGS


1. Featured Ads: The Company offers a service called "Featured Ads," where Users can pay a non-refundable fee to have their ads prominently displayed on selected areas of the Website, potentially enhancing visibility. When purchasing a Featured Ad, Users may need to provide certain information through a third-party service provider, which may have its own terms and policies. The Company disclaims any liability related to the safety or security of information transmitted to third-party websites.

2. Payment Processing: The Company may utilize third-party providers to process credit card payments for users of the Products or services offered. These providers may access personal information solely for payment processing purposes and are prohibited from using it for any other reason. The Company does not retain users’ payment information.

3. Paid Postings: Users are charged a fee to post Paid Material on designated areas of the Website. Each party posting Paid Material is responsible for compliance with these terms. Fees paid for posting Paid Material are non-refundable, even if the Material is removed for violating the terms. Additional terms regarding Paid Material will be provided in the relevant section(s).

4. Job Ads Policy: Job ads announcing multiple positions in one ad will be deleted after 24 hours with no refund. Within the first 24 hours, Users can edit the ad to reduce it to one position. Failure to comply with this requirement will result in ad deletion without refund.


POSTING AGENTS AND NO SPAM POLICY


Posting Agents: The use of Posting Agents is prohibited without express written permission from the Company. Posting Agents are not allowed to post Material on behalf of others or access the Service for posting Material without proper authorization.

No Spam Policy: Sending unsolicited email advertisements or other communications to Company addresses or through Company computer systems is expressly prohibited. The Company may monitor email usage to flag spam or scam-related content. Unauthorized use of Company computer systems may result in civil and criminal penalties under applicable laws, including Rwanda Cybercrimes laws.


LIMITATION OF LIABILITY

 

The Company explicitly disclaims liability for: Consequential, indirect, special losses, or exemplary damages, even if advised of the possibility thereof.

● Loss of profit.
● Loss of business.
● Loss of revenue.
● Loss of or corruption to data.
● Loss of use.
● Loss of production.
● Loss of contract.
● Loss of opportunity.
● Loss of savings, discount, or rebate (whether actual or anticipated).
● Harm to reputation or loss of goodwill.
● Loss of anticipated savings.

In cases encompassing Clauses ‎6.1.2 to 6.1.12 (inclusive), whether arising directly or indirectly, any damages suffered by any User in connection with these Terms or any liability of a User to any third party, the Company disclaims liability to the fullest extent permitted by law.

These limitations also extend to damages resulting from other services or products received through or advertised in connection with the Website or the Service, or any links on the Website, as well as information, opinions, or advice received through or advertised in connection with the Website or the Service, or any links to the Website or Service.

You expressly acknowledge and agree that the Company shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any user or third party, and any risk of harm or damage from such conduct rests entirely with you.

While the Company endeavors to exclude viruses from the Website, it cannot guarantee such exclusion, and thus accepts no liability for viruses. Users are advised to take appropriate safeguards before accessing or downloading any information or Material from the Website.

JOBS CATEGORIES

 

Responsibility for Information: The Company bears no responsibility for the information posted by job seekers in the Jobs Wanted section or within their CVs.

CV Search: The CV Search feature serves as a form of headhunting, enabling recruiters to browse through the CVs within our database. However, it's important to note that not all applicants may match the specific job positions being sought. Fees paid for this service are non-refundable once the package is utilized, and the duration of the CV Search cannot be extended.

Access to CVs: By placing a job-seeking advertisement in the Jobs Wanted section, recruiters gain access to the CVs uploaded to the profiles of job seekers. Once an applicant uploads their CV to their profile, it becomes part of our database, accessible to recruiters for a period of 18 months.

 

PROPERTY FOR SALE AND PROPERTY FOR RENT CATEGORIES ON THE WEBSITE

 

When listing a property on this Website, your obligations are as follows:

Brokers:

● Brokers must obtain rights from the property's owner, permitting them to sell or rent the property.

● Developers warrant that they possess all valid licenses for the given property in Rwanda.
● If a project is off-plan (under construction), it must be registered under Rwanda laws.


Owners and Landlords:
● Owners and landlords warrant that they are the rightful owners or possess valid authorization to list the property on the Website.

● For short-term or holiday home leasing, valid licenses under Rwandan laws must be possessed.


Tenants:
● Tenants must have valid, written consent from their landlord before advertising on the Website and must be legally entitled to do so.


All Advertisers:
● Only properties currently available for sale or lease may be advertised.
● Advertisements must not contain unlawful language or promote illegal or immoral activities under Rwandan laws.
● Unlawful language or use of premises, including defamatory, misleading, or deceptive statements, exceeding lawful occupancy limits, or promoting illegal activities, is prohibited.
● The Company reserves the right to remove any listings at its discretion, and advertising fees will not be refunded.


Additional Obligations:
● The Company’s advertisements include real properties for sale or rent, sourced from third-party brokers, landlords, owners, or developers.
● The Company does not verify property listing details provided by third parties and makes no warranties or representations regarding their accuracy or completeness.
● Users must conduct their own due diligence and should not solely rely on the details provided in the advertisements.
● The Company verifies the license numbers of all property broker companies before allowing them to advertise on the Website

 

VEHICLE CATEGORY


As a user of the Website, you must adhere to the following guidelines when offering vehicles for sale:

Location: Vehicles offered for sale must be located within Rwanda, unless you can provide proof of ownership and are facilitating shipping. The E_MALL Limited holds no liability for any financial losses resulting from transactions with third-party shipping companies.

Immediate Availability: Only vehicles that are immediately available for sale should be listed.

Accurate Description: Vehicles must be accurately described and categorized in accordance with their type.

Ownership and Rights: You must either be the owner of the vehicle or have legal rights to sell it.

Pricing: All listings must display true and accurate pricing for the vehicle.

In some cases, we may request proof of ownership and confirmation of the vehicle’s location in Rwanda or clearance by Rwandan customs. Failure to provide this proof within 24 hours of request may result in the immediate removal of the advertisement/content without further notice, and no refund will be issues.

 

FURNITURE CATEGORY


When listing items in the Furniture & Home Decor category on the Website, users must adhere to the following terms:

Accurate Description: All items listed must be accurately described and categorized under Furniture & Home Decor.

Condition: The condition of the furniture or home decor items must be clearly stated in the listing.

Ownership and Rights: Users must be the rightful owners of the items listed or have legal authorization to sell them.

Location: Items should be located within Rwanda unless shipping arrangements have been made, in which case proof of ownership and shipping details may be required. The E_MALL Limited is not responsible for any financial losses resulting from transactions with third-party shipping companies.

Availability: Only items that are immediately available for sale should be listed.

Pricing: Prices must be accurately displayed for each item listed.

Compliance: Listings must comply with all applicable laws and regulations, including thoserelating to the sale of furniture and home decor items.

 

Failure to comply with these terms may result in the removal of the listing without notice, and no refunds will be provided,
